消費者庁が3か月間訪問販売に関する業務を一部停止するよう命じたのは、家庭向け電気・ガスの販売を行う「ニチガス（日本瓦斯）」です。
消費者庁によりますと、自宅を訪問して電気やガスの営業活動を行う際に、契約しない意思をはっきりと伝えられたにもかかわらず、「簡単に済む」として勧誘を続けた行為が特定商取引法違反にあたるということです。

また、実際には料金が安くなることはないにもかかわらず、「1年を平均すると、切り替えたほうがメリットがある」と事実と異なることを告げて勧誘を行っていたケースもあったということです。
全国の消費生活センターなどには、このようなニチガスの勧誘に関する相談が、2020年度からの3年間で、850件以上寄せられています。

ニチガスは、今後の営業活動においては、コンプライアンスの遵守に一層の注意を払うとした上で、事実関係や処分の内容について「見解の相違がある点については法的措置をとることを含め、見解を主張していく」としています。
また、消費者庁は、ニチガスにかかわらず電気・ガスの小売業者による特定商取引法違反が相次いでいるとして、消費者に対して、契約を締結する際にはよく確認するよう呼びかけるとともに、経済産業省に対し、これらの事業者に対して注意喚起を行うよう求めました。

　卸電力市場の価格が低く推移する状況で、新電力の経営状況に明暗が分かれている。
２年前の市場価格高騰を経験し、相対契約による電源調達を積み増した新電力は苦戦を強いられる。
市場価格の下落を追い風に、市場連動型プランの提案を進める新電力は息を吹き返す状況にあるが、火種は消えたわけではない。
小売電気事業のリスクをどうマネジメントするか、難しい局面が続く。

　新電力は２０２１年秋頃から苦境に立たされていた。燃料高などを背景として、日本卸電力取引所（ＪＥＰＸ）のスポット価格が断続的に高騰したためだ。
調達を市場に依存するビジネスモデルは転換を余儀なくされ、撤退を迫られる新電力も相次いだ。

公正取引委員会は17日、電力自由化後の電力分野の取引に関する提言を公表した。大手電力会社の小売部門が発電費用などの供給コストを著しく下回って電気料金を設定した場合、独占禁止法違反の恐れがあると説明した。自由化後に参入した新電力の競争を妨げている可能性がある。

大手電力の小売部門が採算性を度外視し、低料金で家庭向けに販売すれば、経営余力が小さい新電力の競争を阻害する。不当廉売など独禁法違反の恐れがあるとした。

電気代には消費者保護の観点で値上げ幅に上限を設けた「規制料金」と、上限がない「自由料金」の2種類がある。大手電力に適用している規制料金は改定に国の認可が求められる。

公取委は規制料金について、燃料など調達コストが高騰してもすぐに販売価格に反映しにくい性質があることを指摘し、電取委に制度の検証を求めた。

　２０１６年４月の小売全面自由化からもうすぐ８年が経とうとしているが、低圧規制料金は経過措置の名の下で今も存続し続ける。ロシアがウクライナに侵攻した２２年には、規制料金に適用される燃料費調整制度と合わせ、その弊害が一気に露呈した。
　各みなし小売電気事業者が燃料価格高騰分を転嫁できる上限を突破し、規制料金が最も安い料金メニューとして存在するいびつな状況となった。上限を超えた分のコスト負担が、各みなし小売りにとって重荷になる一方、新電力からも多くの顧客がみなし小売りに流れる事態を招いた。

2020年末からのエネルギー価格高騰で電力調達コストが膨らみ、新電力会社は「逆ザヤ」状態に悩まされてきた。
だが、2023年には市場価格が下落し、契約先の新電力会社の倒産や撤退により大手電力会社等から供給を受ける事態となった「電力難民」数を示す「最終保障供給契約件数」も3月1日時点で5912件と、ピーク時の2022年10月（4万5871件）に比べ87.1％減少した（電力・ガス取引監視等委員会、3月15日公表）。

　「倒産」は、地元電力（株）（福岡県、2023年12月破産、負債5億9000万円）、（株）スマートテック（茨城県、2024年2月民事再生、負債45億7100万円）とグループ会社の水戸電力（株）（茨城県、2024年2月民事再生、負債4億8000万円）の3社が今回調査で判明した。3社とも、電力販売事業に際しての電力の調達は卸市場や他企業など外部からの仕入れが中心で、市場での調達価格と需要家への販売価格が逆ザヤとなり収益を圧迫した。
